Terms of Service

Effective date: 16 April 2026

These Terms of Service ("Terms") form a legal agreement between you and Ilya Komichev (sole operator) ("ToThem", "we", "us") regarding your use of the ToThem mobile application and the website at to-them.org (the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the age of digital consent in your country, whichever is higher. By using the Service you confirm that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to bind that organization.

2. Your account

You are responsible for the security of your account credentials and for any activity under your account. Notify us at ilya.komichev@gmail.com if you suspect unauthorized use. We may require you to verify your identifier (phone number or email) and may suspend the account if verification fails.

You agree not to create accounts using automated means, not to impersonate other people, and not to maintain more than a reasonable number of accounts.

3. The Service

ToThem is a private messenger and social feed application. Features may change over time. We may add, remove, or modify features at our discretion. We will not remove paid features without a refund or a reasonable replacement during a paid period.

The Service is provided as a tool for personal communication. It is not a backup service, not a notarial service, and not a service of record for legal purposes.

4. User content

"User Content" means anything you upload, send, or publish through the Service: messages, posts, photos, videos, audio, and other materials.

You retain ownership of your User Content. By submitting User Content you grant ToThem a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process that content solely to operate the Service for you and your intended recipients. The license ends when you delete the content or your account, except for backups that are rotated under our retention policy.

You are solely responsible for your User Content. You confirm that you have the necessary rights to the content you submit and that the content does not violate any law, contract, or third-party right.

5. Acceptable use and content policy

You may not use the Service to send, publish, or facilitate any of the following:

Illegal content. Content that is unlawful in your jurisdiction or in the jurisdiction of the recipient, including child sexual abuse material, content that incites violence or terrorism, and content that infringes intellectual property rights.
Harassment and threats. Targeted harassment, stalking, doxxing, threats of violence.
Hate speech and discrimination. Content that promotes discrimination, hatred, or violence against people based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics.
Sexual content involving minors. Strictly forbidden in any form. Any such content is reported to authorities and the account is permanently terminated.
Non-consensual intimate imagery. Sharing of intimate imagery without consent.
Spam, scams, and fraud. Unsolicited bulk messages, phishing, impersonation, financial scams.
Malware. Distribution of viruses, worms, ransomware, or any malicious code.
Privacy violations. Sharing personal information of others without consent.
Service abuse. Reverse engineering, scraping, denial of service, bypassing rate limits, automated mass messaging.
Adult content without labels. Sexual content must be marked and is allowed only between consenting adults in private chats. Public posts may not contain explicit nudity or sexual content.

These rules apply both to private messages between consenting users and to publicly visible content. Private messages are not actively scanned by us, but if a user reports content we will review the report.

6. Reporting and moderation

You can report objectionable content or abusive users from inside the app:

Long-press a message or open a user profile.
Tap Report.
Choose a reason and submit.

Reported content is reviewed by our team within 24 hours. We may remove content, restrict an account, or terminate access depending on severity. We may also act proactively when we become aware of violations.

You can block any user from inside the app. Blocked users cannot send you messages, see your profile, or interact with your posts.

7. Termination

We may suspend or terminate your account at any time if:

you violate these Terms or the Acceptable Use rules;
the account is dormant for an extended period and we sent prior notice;
continued provision of the Service is not technically or legally feasible.

You can delete your account at any time as described in our Privacy Policy and at https://to-them.org/delete-account.

Termination does not relieve you of liability for actions taken before termination. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, dispute resolution) survive.

8. Intellectual property

The Service, including the app, the website, the brand, the icon, and all related content (other than User Content), is owned by Ilya Komichev (sole operator) and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms. We reserve all other rights.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of the Service except as expressly permitted by law.

9. Third-party services

The Service relies on third-party providers (see our Privacy Policy). Third-party content shown inside the Service (for example, link previews) is provided by the originator and we do not endorse it.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will be preserved without loss.

You are responsible for keeping your own backups of important content.

11. Limitation of liability

To the maximum extent permitted by applicable law, ToThem will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.

In no event will our total liability arising out of these Terms exceed the greater of (a) the amount you paid ToThem in the 12 months before the event giving rise to liability, or (b) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the limitations apply only to the extent permitted.

12. Indemnification

You agree to indemnify and hold Ilya Komichev (sole operator), his contractors, and partners harmless from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

13. Governing law and disputes

These Terms are governed by the laws of your country of habitual residence, unless overridden by mandatory law. Disputes will be resolved by the competent courts of your country of habitual residence, except where mandatory law requires otherwise.

For users in the European Economic Area, the European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to the Terms

We may update these Terms. The "Effective date" reflects the current version. If changes are material we will notify you in the app and by email at least 14 days before they take effect. Continued use after the effective date means acceptance of the updated Terms.
